Sisalelwe izinsuku eziyisishagalolunye (9) ukuthi sitshele uMnyango Wezasekhaya ukuthi mawusule iziphakamiso ezingahambisani nobuntu, ezihlose ukudicilela phansi isithunzi sabafowethu kanye nodadewethu abasuka kwamanye amazwe e-Afrika yonkana. Izimpi, udlame, ububha kanye nokushushiswa kungezinye zezizathu eziholela ukuthi abantu bafudukele eNingizimu Afrika, njengoba izakhamuzi zalapha zenza njalo ngesikhathi sobandlululo.

UMnyango Wezasekhaya ukhiphe umqulu, phecelezi i-Green Paper, mayelana nokufuduka kwabantu kumazwe ngamazwe omema umphakathi ukuthi uphawule ngokuphakanyisiwe [1]. Lokhu kusinika ithuba lokuthi sifake imibono yethu mayelana nemithetho elawula ukufuduka kwabantueza kwelaseNingizimu Afrika; ukuze siqiniseke ukuthi le mithetho iyabavikela futhi ihambisana nokuthuthukisa ukuvikelwa kwamalungelo abantu kwiSADC.

Kuneziphakamiso ezinhle eziqukethwe kwi-Green Paper, kodwa ongoti abasuka kwi-Lawyers for Human Rights, i-Consortium for Refugees, i-Migrants South Africa (CoRMSA), i-Scalabrini Centre kanye neLegal Resource Centre baxwayisa ngezinye iziphakamiso ezenziwe ezingaxhaswa ubufakazi, ezingavikeli isithunzi, futhi ezizobiza imali eshisiwe ukuze zigcwaliswe.

Lo mqulu ugcizelela ukuthi izimpabanga eziseNingizimu Afrika ziyayona imithetho yezwe isikhathi esiningi (p 40), okuyisizathu sokuthi izinga elingama 90% lezicelo zokufuduka zichithwe (p 29). Uhlelo olumisiwe njangamanje lugcwele ukukhwabanisa ukuhleliwe [3], ukucwasa [4], futhi alunawo amandla okuqukatha izinqumo [5] ezilungile mayelana nezicelo zokufuduka. Buningi ubufakazi obuseka lokhu okubalwa kukho ukusebenza kweHhovisi lezimpabanga eMusina eLimpopo lapho kungekho nasinye isicelo sokufuduka esike saphumelela ukuze sibone ukuthi lolu hlelo lunezinkinga [6].

Esikhundleni sokubheka izindlela zokulwisana nalokhu, i-Green paper ineziphakamiso mayelana nokuthuthukisa ingqalasizinda emingceleni yezwe lapho izimpabanga ezibalekela igcindezi, ukushushiswa, izimpi, kanye nobubha zizogcinwa khona ngesikhathi zisalinde impendulo ngezicelo zazo zokungena EeNingizimu Afrika (p 65). Uma ingqalasizinda sizofana nalesi esisaziyo saseLindela, lokhu kuzobe kubeka obala ukuthi iNingizimu Afrika ihlose ukudicilela phansi amalungelo abantu ngalezi ziphakamiso ezenwe kwi-Green Paper [7][8]. Umqulu uveza ukuthi lesingqalasizinda sizofana nalezi ezitholakala kumazwe afana no-Australia kanye neCanada (p 66), esezigxekwe umhlanba wonkana ngokudicilela phansi amalungelo abantu [9]; okuyinkomba yokuthi lezi ziphakamiso akufanele sizivumele. Izimpabanga ezise-Australia zize zizithunge imilomo yazo ngenhloso yokuveza ukudicilelwa phansi kwamalungelo azo [10].

Njengoba umqulu ungasiniki imininingwane ngeziphakamiso ngengqalasizinda, lokhu kuzodala ukuthi uhlelo lokucwaninga izicelo zezimpabanga zenziwe ngendlela engekho obala, kuchithwe abantu abadinga usizo, futhi siziphathe ngendlela engavezi ubuntu. Lesingqalasizinda sizobiza imali eshisiwe ngoba kuzodingeka ukuthi izimpabanga zihlinzekelwe ngokudla, ngezempilo, ngezemfundo kanye nendawo yokuhlala; okuzogcina kuholela ekutheni ibencane imali esetshenziselwa ukuletha izidingongqangikwizakhamuzi. Kubalulekile ukuthi sinike uMnyango Wezasekhaya umyalo ocacile wokuthi usule iziphakamiso mayelana nesingqalasizinda, kodwa ubhekane nezinkinga ezikhungethe amahhovisi amukela izimpabanga kanye nezinye iznkinga kuhlelo lokuphathwa kwazo.
